TERMS AND CONDITIONONS:
These Terms and Conditions are valid for all tickets issued no later than 31/12/2020
The Tnitsea Shipping Lda (henceforth referred to as TNIT Lda , owner of the trademark EUROPEAN FERRIES) operates as the owner of the Carrier. The route of the voyage is shown on the ticket.
The passengers, their luggage and accompanied vehicles are carried exclusively at the Terms and Conditions of the Carrier.
The passenger, buying a ticket, accepts ipso facto these terms and conditions outlined below.
Similarly at the time of reservation and / or purchase of the ticket the passenger authorizes ipso facto the processing of personal data as specified in the Privacy Policy appearing at the end of this document and in accordance with the legislative decree 196/2003.
DEFINITIONS:
“Carrier” means the Shipping Company that performs the sea transport service.
For “luggage owned by the passenger” means hand luggage not registered or stored in his vehicle parked in the garage of the ship or deposited in the luggage compartment of the ship, and contains only personal belongings of the passenger.
“Vehicle following” means any powered vehicle (including any trailer), used for the transport of persons, and goods, not intended for sale, which owner or legal user is the passenger named on the ticket.
POWER OF THE MASTER:
The ship’s captain, the “overriding authority,” has full power to tow and assist other vessels under any circumstances, to deviate from the standard route, to call at any port which (is, or is not, on the itinerary of the ship), to transfer passengers and their luggage onto another vessel for the continuation of the trip.
The Carrier and the Master of the vessel have the right to refuse passage to anyone, at their discretion, who is not physically able to make the sea voyage.
Furthermore the Carrier and the Master have the right to disembark in any port , during the voyage, any passenger who is unable to continue the voyage and who may cause danger or inconvenience to other passengers or to crew.
The passenger is subject to the disciplinary powers of the ship’s Master for all matters concerning the safety of the ship and navigation. The Carrier and the Master of the vessel shall be permitted to carry out any order or direction given by Governments and authorities of any state or of persons acting, or claiming to act, on behalf of or with the consent of such governments or authorities or any other person who, under the terms of the war risks insurance of the ship, has the right to issue such orders or directives.
All actions and omissions undertaken by the Carrier or Master in execution or as a consequence of such orders or directives shall not be considered breach of contract.
The disembarkation of passengers and baggage in accordance with such orders or directives discharge the Carrier from any responsibility for the continuation of the journey or the repatriation of the passengers.
THE SHIP:
The in-service ships are Ferry Ro / Passengers , used for transporting passengers and goods. The published schedules and timetables can vary due to weather reasons, port operations, and port traffic without prior notice. Any delay that might arise is no motivation for cancellation of the trip and in no case offer entitlement to a refund or compensation of any kind.
RESERVATIONS:
Reservations can be made with your travel agent, the offices and agents of TNIT Lda. The ticket is payable on confirmation of booking. The payment of the ticket is due to the Carrier (or his representative) when booking. No passenger ticket can be issued without full payment . In compliance with legislation on Security, the names of passengers, the information concerning ID document, the make, type and vehicle license plate on the ticket have to correspond to the passengers and their vehicles at the start. Otherwise access to the port and to the vessel may be refused.
RULES:
Passengers, luggage and vehicles are carried under the Navigation Code, in accordance with the Italian law and by international conventions on the subject ratified by the Italian state as well as by Community legislation. In accordance with the purposes of article 19, paragraph VI of the EU Regulation n. 1177/2010 the Carrier establishes that the minimum threshold for financial compensation is € 6.00 (six).
It is also understood that the Carrier will not be responsible for the delay and / cancellation of voyage if the event is due to a “FORCE” and / or “unforeseeable circumstances” such as, but not limited to, adverse weather and sea conditions, strikes of port operators, technical failure of the ship that have unpredictable character and inevitability, the provisions of the Maritime Authority, seizure of the ship and so on.
TICKETS (Contracts of carriage):
The passenger ticket is valid only for the people whose name is shown. The ticket is not transferable. The ticket can be of paper, fax, or e-mail. On check-in the passenger will be given a boarding pass and documents necessary for any accompanying vehicles .The passenger is required to keep both documents ( “ticket ” and “boarding pass”) for the entire voyage as proof of payment of passage, and to avoid the necessity of having to purchase a second ticket as receipt of passage. In case of any complaint, the passenger will be required to produce a copy of both the ticket and boarding pass.
PRICES:
For each maritime connection, the basic rates, accommodation, and fixed charges are posted at the representative agencies (or web sites belonging to them). The rates are subject to fluctuations (i.e. sudden increase in the cost of fuel); the same are detailed in any case before the completion of the purchase and payment by the customer.
Pursuant to Article 33 of the Consumer Code the Carrier has the right to vary rates before departure and before booking has been completed, for both the outward and return journey, and the consumer has the right of withdrawal, Article 33 of Legislative Decree n. 206/2005 (Consumer Code).
LIMITATIONS OF LIABILITY ‘ :
The Carrier’s liability for loss of life or personal injury or for loss or damage to luggage, vehicle, valuables, personal items and other properties of the passenger shall in no case exceed the limits provided by the Navigation Code and Italian law, except where and when such are applicable by International Conventions, and in particular the Athens Convention of 13.12.1974 as modified by the London Protocol of 11.19/1976.
ON BOARD SHIP :
Passengers are required to strictly observe discipline on board and to comply with the regulations for maritime transport and in particular those relating to safety of navigation.
It is strictly forbidden to smoke inside the ship. The crew is obliged by law to ensure compliance with this prohibition and to report any infraction to the competent authority in accordance with the law of 16/01/2003 and its Implementing Agreement of 16/12/2004.
Failure to comply with a statutory provision, on-board regulation, order or regulation of the Authority on security shall be punished in accordance with applicable civil and criminal laws. In accordance with the antiterrorist measures in force (ISPS) a passenger can, at any time, be subject to luggage search and / or request for exhibition of identity documents by the officers of the ship.
BOARDING:
The passenger must present themselves for check-in at least two hours before departure (from / to non-EU countries at least three hours). Otherwise the passenger loses the right to board even with a reservation.
When boarding the passenger has to be in possession of regular ticket, a valid identity document and any and all documents required for the disembarkation in countries of final destination and any countries in transit.
The vehicles shall be embarked in the sequence decided by the Master of the ship and / or his subordinates, and can be parked on any deck of the ship.
TRAVEL DOCUMENTS:
Citizens of a country of ‘EU: for non-EU countries, identity card valid for foreign travel or valid passport; Non-EU citizens: Valid passport with a valid residence permit or visa for a country in the Schengen area.
Before embarking on the journey, passengers must be in possession of all the documentation necessary to disembark in the port of destination. The Carrier shall in no way be responsible for eventual refusal of entry to the destination country.
BOARDING MINORS :
Minors must be in possession of valid personal identity document, in accordance with the provisions of EC Regulation no. 2252/2004. (See the travel documents).
Passengers under 12 years cannot under any circumstances travel unless accompanied by an adult. If this is not one of the parents the responsible adult has to deliver to the Master / Chief Purser a letter of foster care with which the parents say they entrust their child to a designated person, who will be responsible for all legal purposes . This letter must be accompanied by valid identity documents, of both parents and, in the case of non-EU residents, a residence permit is required of the parents and child. Minors over 12 years will be admitted on board the ship as long as they deliver to the Master of the vessel / Chief Purser, a release letter signed by both parents, with attached documents of both parents, in which they declare to accept all the consequences for any personal injury, and / or caused to third parties. In no event shall the Master of the vessel and / or crew member take custody, or the responsibility of the child on the ship; it is understood that the passenger will have the responsibility to obtain all necessary documentation required by the destination country and the Carrier shall not assume any responsibility in the event that such documentation would be considered insufficient by the authorities in the port of destination.
BOARDING OF PREGNANT WOMEN:
Women in an advanced state of pregnancy, more than 6 months, can travel only if equipped with a medical certificate authorizing the trip and has been issued no more than 7 days before the date of departure.
If the pregnancy is complicated, the pregnant passenger will have to provide a medical certificate authorizing the trip regardless of the months of pregnancy. Boarding will not be allowed to women who have given birth within 7 days prior to departure, or to any woman expected to give birth within seven days.
The Master of the vessel has the right to refuse passage to any pregnant woman who the Master deems not to be in condition to make the journey.
If the Master refuses boarding for a justified reason, the Carrier will be liable only to reimbursement of the cost of the passenger ticket.
DISABLED BOARDING :
For disabled passengers; this means people who are not able to move easily or freely, or seek assistance. Reservations and tickets shall be offered them on the same terms as all other passengers. It is necessary that the disabled person reports in writing, at the time of booking and before purchasing the ticket, the specific requirements for accommodation, seat, and services required, or their need to bring medical equipment on board. The number of cabins adapted is limited , so before purchasing their ticket it is necessary to ascertain the availability.
If boarding is denied to disabled passengers for safety reasons or due to inability of ship design or infrastructure, they will be entitled only to reimbursement of the ticket.
The assistance to disabled passengers is provided by the Chief Purser or other responsible person . If the ship has been given prior notice of the arrival of a disabled passenger, the Chief Purser shall prepare the necessary assistance for the smooth running of the trip, from embarkation to landing. The Chief Purser will inform the captain and register the accommodation of the passenger.
The staff on board chosen to assist the disabled passenger will always wear a reflective jacket bearing the words CREW ASSISTANCE, so that they can easily be recognized by passengers.
For any other type of assistance, the disabled passenger must notify the Carrier or the terminal operator, at least forty-eight hours in advance and show up at the appointed place at the appointed hour, which will be earlier than the published embarkation.
If the Carrier or the terminal operator by fault or negligence, causes loss or damage to mobility equipment or other specific equipment used by disabled persons or persons with reduced mobility, compensation is necessary corresponding to the value of replacement equipment or, where appropriate, the cost of repair.
The special card will be issued to disabled persons embarking with their vehicle, and must be placed on their vehicle as their vehicles will be assigned a priority parking space on board. In case of emergency on board the “ responsible person” assigned to the disabled person will help them to get to the Muster Point.
DRIVERS:
Driver means any driver of a commercial vehicle loaded onto the ship. There may be multiple drivers for a single vehicle. The price of the passage is established from ‘Goods Office and must be included in the bill of lading, along with name of the driver. The latter must be in possession of identity documents required for the journey and for disembarkation in the country of destination. SOLAS and Decree of 13/10/1999 drivers are assimilated with the passengers. Each driver receives at the check-in a regular boarding pass. Subject to availability drivers will be assigned a bunk.
HEALTH AND VACCINATION:
Passengers are deemed to be in good health, physical and mental; and while a cabin/hospital shall be available, under European regulations the route covered by the carrier does not provide a nurse / doctor.
If there is a doctor/nurse on board they are enabled only to provide first aid and care, but not the administration of any medication.
A passenger who had to seek medical assistance on board, where available, will sign a release in favor of the shipping company.
INSURANCE:
The owner and the carrier have insurance issued by the P & I Club but is limited with regard to their liability to third parties. We strongly recommend passengers to take out an external insurance policy against cancellation charges, luggage, medical assistance and repatriation.
VEHICLES :
They are considered “vehicles accompanying passengers” only vehicles not containing commercial goods. A vehicle containing other than personal items, must travel as cargo.
If a vehicle is denied boarding because the vehicle is shipped as a “vehicle owned by the passenger”, but it contains commercial goods , there is no refund.
One vehicle per passenger: If the vehicle showing up for embarkation belongs to a different booking code than that indicated on the ticket (for example the vehicle is higher or longer ), the passenger loses the right for embarkation (without refund of ticket).
If there is space on board the passenger will have to pay the difference between the categories, plus any expenses. The vehicle will be embarked and disembarked by the passenger, and when parked on board the handbrake and gear must be engaged.
The vehicle must be locked. Access to the garages is prohibited during the crossing.
In the case of trailers etc., the passenger must provide the company in advance a written statement certifying the use at their own cost of a tow truck, both for boarding and for the disembarking . In the absence of such documentation access to the ship can be refused.
Drivers are obligated , upon embarkation, to declare if their vehicle is equipped with a natural gas or LPG fuel system. The vehicle using a gas fuel system must comply with all applicable regulations and this compliance shall be duly certified in the vehicle registration document.
During the time when the vehicles are stowed on board the interception valves of the GAS tank have to be closed. Passengers must be in possession of all documents required for the disembarkation of the vehicle at the port of destination. In case of incompleteness of such documentation, the Carrier disclaims any liability.
Any and all costs and expenses arising from the embarkation, disembarkation and customs clearance of the vehicle shall be borne by the passenger.
Any damage caused by the vehicle to the ship and / or any third party liability shall be paid for by the passenger responsible, or through his insurance. The Passenger may however at any time be asked to sign a declaration of liability for damages before disembarking from the ship.
It is also advisable to take out an insurance policy to cover any damages that may occur during the maritime transport for which the Carrier cannot be held responsible, the Carrier answers, in fact, only to damage resulting from its own responsibility and within the limits prescribed by the Italian Navigation Code or from any applicable International Convention.
BAGGAGE:
Only personal effects are allowed as free baggage. The baggage must not contain goods intended for marketing. Dangerous and hazardous goods are not allowed (the list of dangerous and hazardous goods include, but are not limited to: weapons, explosives and drugs).
Passengers are requested to bring with them the luggage necessary for the crossing because the garage will remain closed during navigation.
Each passenger in cabin accommodation is entitled to bring in one suitcase. Passengers with accommodation in ATS or DECK can carry only a modest-sized carry-on bag.
Baggage in excess of the limits indicated above, unless stored in or on your vehicle, shall be deposited in the luggage area paying the corresponding price.
Household goods and furnishings must be declared and placed in the garage. The carrier’s liability for baggage cannot in any case exceed the limits provided by the Navigation Code, or the International Convention may be applicable, and always within the limits of 30 kilograms per person for unchecked baggage, including that which is carried inside or on the vehicle, or deposited in the baggage compartment of the ship.
The Carrier is not in any way responsible for any theft, loss, loss of or damage to jewelry, money, documents, manuscripts, valuables or valuable items (personal and otherwise), wherever they are taken on board.
CURRENCY:
The on-board currency is the Euro. There is no currency exchange. We do not accept checks.
CHILDREN:
Discounts for children are listed in the tariff. The age of the child must be documented on day of travel.
PETS :
The transport of animals other than pets must be excluded as “accompanying”, and should be treated with an agreement “ad hoc.” Without exception animals have to travel in the kennels. It is strictly forbidden to keep animals in the cabin or passenger area. The passenger must provide the animal’s food. The ship is in no way obliged to provide food, but only water. The access to the kennels, where placed in a forbidden zone, is allowed only at the times specified by the Master. The passenger must personally take care of the pet and is obliged to remove droppings, and leave kennels clean.
The Owner is responsible for the animal . Damage to the ship, persons or property, shall be compensated on the spot. The Owner is responsible for vaccinations and other procedures required for traveling or to disembark at the port of destination. Pets must be booked in advance.
Branch offices that have direct access to the Computerized Reservation System, must in any case check in advance the availability of the kennel. The animal must be included in the ticket.
For pets it is mandatory: for international routes and extra Schengen area the European passport (PET), the leash and muzzle. For national routes pets must be registered (microchip registered), and have the certificate of good health issued by the veterinary surgeon, the leash and muzzle.
If a passenger comes to the ticket check-in with an animal not scheduled on the ticket, the port agent shall proceed as follows: check availability of kennels on board, and issue upon payment a ticket.
The Master must enforce the rules for the transport of animals. In no case, without exception, it can be tolerated the presence of animals in the cabin and passenger spaces. Animals cannot travel under any circumstances inside the vehicles of passengers. In the case where a passenger is found with an animal on board, not mentioned on the ticket, this is to be excluded as “accompanying” and should be treated “Ad Hoc”.
Blind Passengers will travel accompanied by their guide dog, according to the provisions of Law 25 August 1988. Legislation n. 376, at no additional cost. The guide dog may travel in the cabin with the passenger. The presence of the guide dog should be reported upon boarding. The limitations and restrictions for the transport of domestic animals are necessary for the good of all passengers. The guide-dog must wear a muzzle when required by the ship’s Master or passengers.
CANCELLATION AND CHANGES BY THE PASSENGER:
Cancellations must be notified in writing to the Carrier or at the travel agency where the ticket was purchased. The following penalties apply to the total ticket amount, i.e. for passengers and vehicles .
10% up to 30 calendar days before departure;
30% from 29 to 7 calendar days before departure;
50% from 6 to 2 days prior to sailing:
100% from the day before and / or no show;
NO REFUND WILL BE ‘MADE FOR’ CANCELLATION OF TICKETS / RESERVATIONS WITH OFFER “EARLY BOOKING”
The loss or theft of a ticket must be reported immediately to the agency that issued the ticket or to the port office. A duplicate ticket cannot be issued. The unused ticket can be reimbursed as long as it has NOT been used in the previous six months. Once a ticket has been modified in any way it cannot be annulled. No refund is granted for missed embarkation due to refusal by authority or due to missing or insufficient personal or vehicle document. Only the Company reserves the right to change the specifications of departures and cancellation of tickets if asked by the passenger.
CONDITIONS OF AMENDMENT OF TICKET BY THE PASSENGER
All amendment of tickets, whether “early Booking” or otherwise, are subject to restrictions. A charge of 15.00 euro will be made plus the eventual extra cost of the ticket issued at a later date.
Date Variation: date of ticket can be amended once only, and up to two days before the date departure on the condition of settlement of any additional charges, and eventual space on vessel for the passengers and vehicles.
Name change of passengers : It is impossible to change the names of the passengers on tickets already issued.
COMPLAINTS:
Any complaints must be submitted to the carrier or travel agent, in writing. The T. S. Lda reserves the right to modify the terms and conditions of change and cancellation for certain departures.
RESOLUTIONS OF DISPUTES:
All disputes arising from the contract of carriage passengers will be referred to the Chamber of Commerce of the place of residence and / or domicile of the consumer and resolved according to the Conciliation Rules . The attempt at conciliation constitutes a condition of admissibility of any legal proceedings under Article 5, paragraph 5, of Legislative Decree n. 28/2010.
DECREE 13 October 1999:
(Directive 98/41 / EC on the registration of persons on board passenger ships.)
Upon booking, the customer must provide the following information: surname, first name, nationality, date of birth, sex, n ° phone, e-mail address.
Moreover, the passenger has the right to indicate specific necessities for care and / or assistance in emergency situations. The data provided will be treated in compliance with Law n. 679 /2016
INFORMATION AND CONSENT IN ACCORDANCE WITH OF LEGISLATIVE DECREE 196/2003:
1. Purpose of the processing of personal data:
Personal data is required by Seamed Trading Shipping srl with registered offices in Brindisi of which the address is; Enrico Fermi 24 Italy.
Personal data is held only for the length of the voyage and for this reason, consent to Legislative ( GDPR) is necessary. Personal data will be kept in respect to law 679/2016 UE.
